Zalman Tech Co., Ltd. has finally won a utility/registered design patent infringement lawsuit, a total of 17 cases, against PC Cooler. In accordance with the final judgment, PC Cooler must cease all patent infringing manufacturing and sales activities and compensate Zalman for damages equivalent to an amount of approximately US$158,000 (RMB?1,070,000.00).
According to the ruling of Guang Zhou High People’s Court, PC Cooler, a Chinese manufacturer of imitation goods, can no longer proceed with utility/design patent infringement activities.
Thus, Zalman has confirmed that it will take strong measures against any other Chinese manufacturers and retailers involved in patent infringement activities related to Zalman’s products. Also, Zalman has secured an opportunity to increase its market share in China. Furthermore, this case has revealed that competitive technologies and related intellectual property rights can be protected in China, and that China’s position on protecting intellectual property rights is changing positively.
